This is the licensing you agreed to when acquiring the embroidery files of PDF patterns purchased on this site. This agreement is legally binding. All embroidery design files and digital patterns are Copyright Ballyhoo Creations 2021. By downloading these digital products you agree to the following:

  1. All embroidery design files and digital patterns are Copyright © Ballyhoo Creations. These files can NOT be reproduced or distributed without the written permission of Ballyhoo Creations. This includes digital embroidery files, PDF documents, photos/ videos, or any written text or diagrams.

  2. These files are licensed to you as an INDIVIDUAL and cannot be used by a group of people unless each person purchases their own license and files.

  3. You CAN (and I hope you do!) embroider or sew projects with these files and sell those finished projects (a doll, an embroidered shirt, you get the idea!) This is the Ballyhoo way of promoting small handmade businesses in the creative arts. You may sell your finished projects at places like craft fairs, Etsy, your website, or brick-and-mortar stores. Mass commercial production by a factory is not allowed.

  4. You (the customer) MAY NOT share, loan, rent, or sell these Ballyhoo digital files with anyone, even if you obtained it for free. 

  5. If you downloaded these files from a website allowing unlimited commercial use, please understand that commercial usage applies to YOUR finished physical projects, not the digital files themselves. Refer to the Terms of Service of the site you purchased from for full details.  (This is regarding Creative Fabrica and their commercial use license)

  6. You CAN make a backup copy for your own file security (to protect against a hard drive crash, accidental delete, etc.)

  7. You should download your files within ONE month of purchase and store them in a safe place.  Although Ballyhoo Creations may store your purchases so you may download them again in the future, there is NO guarantee this amenity will always be available.  We only guarantee downloads for one month after your purchase.

  8. Of course, you CAN stitch projects for yourself or others. This includes gifts and charity donations.

  9. You MAY NOT modify any part of Ballyhoo designs with the intent to distribute. This means you may not sell, trade or share your own version of Ballyhoo artwork as embroidery files, graphic design files, files used in electronic cutting machines, or any other sort of digital file in future technology.

  10. You ARE allowed to create or modify your own digital files for personal use, such as a digital cutting file to accompany an embroidery design or add text to one of Ballyhoo’s designs for your own use with your embroidery software.

  11.  REFUNDS are not given on digital download files.  This is the industry standard for digital downloads.  But rules have exceptions.  If you feel you are owed a refund or credit due to duplicate orders OR files that will not work (photo evidence may be required along with some cooperative troubleshooting), then please contact Ballyhoo Creations on the “contact” page to see if we can work something out.  Customer satisfaction is HUGE at Ballyhoo Creations.

  12. During the checkout process, you are required to check a box agreeing to these licensing terms BEFORE paying for the designs and patterns on this website, or joining as a member.  Therefore this agreement is legally binding.  These terms are also included in your downloaded package of files.

  • Payments are processed through 3rd party platforms and Ballyhoo Creations does not have access to your credit card number or paypal information.  This is all "behind the curtain" stuff which is handled by the corporation processing your payments.  We use Wix payments and Paypal to process payments.  Google or Apple Pay may be available in the future.

  • Social media login data may be used to login to the Ballyhoo Creations website if you choose to use those services.  We do not have access to your login info with those social media providers, it is handled through the Wix website platform and their agreements with Google, Facebook, etc.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Some information such as your Internet Protocol (IP) address and/or browser and device characteristics is collected automatically when you visit our Services.  This information is collected into analytic reports to help us understand where our audience is coming from and what devices they use suckh as desktop/tablet/mobile for us to provide the best website performance to the majority of customers.  No personal information is collected as a part of this analytical reporting of website traffic.

Your data is not shared or sold with any 3rd parties.  But it may be used in other ways for marketing and improvement of our services such as:

No.  Ballyhoo Creations is aimed at adults aged 18 and over.  The majority of our customers are over the age of 40.  We do not knowingly collect personal information from minors.

  • Ballyhoo Creations is located in the United States of America and follows all applicable laws of the USA. 

  • We try to follow laws for other nations when possible but cannot keep up with the ever-changing landscape of Privacy laws for a multitude of countries.

  • If you feel this site is not respecting the privacy laws of your country of origin, please CONTACT us to discuss the matter so we may consider making changes to our website.

  • You may CONTACT us at any time to remove your personal data from our website.  (as stated above, we do not store or have access to payment data such as credit card numbers)   This would also mean you would lose access to all online forums, memberships, courses, and design libraries as our website is only structured to provide those services to logged-in users.

  • You may login to your account at any time and change your privacy and personal settings.  This can be done using the account menu at the top right of any webpage on BallyhooCreations.com.  If you are having difficulty logging in, please CONTACT us for assistance.  We may ask questions about your purchase history to verify your identity.
